The procedure for renouncing Russian citizenship is regulated by Federal Law No. 138-FZ of April 28, 2023, "On Citizenship of the Russian Federation" (the "Citizenship Law"). The law contains specific provisions clarifying the procedure for renouncing Russian citizenship.

It is important to note certain grounds under which renunciation of Russian citizenship is not permitted. For instance, a provision has been added stating that renunciation is prohibited if enforcement proceedings are pending against a Russian citizen.

Furthermore, renunciation is not allowed if there are unfulfilled obligations to the state. This includes outstanding obligations to the Russian Federation, its constituent entities, and municipalities, such as the payment of duties, taxes, fees, and fines.

Military Service and Other Obligations

The law defines "other unfulfilled obligations to the Russian Federation." These obligations include the duty of male Russian citizens to serve in the military by conscription, as established by the Federal Law "On Military Duty and Military Service."

Consequently, if a male citizen of the Russian Federation between the ages of 18 and 30 has failed to fulfill his military service obligation without legal grounds, he will not be permitted to renounce his Russian citizenship.

To renounce Russian citizenship in the United States, you must contact the consular section of the Russian Embassy with a specific set of documents, including:

  • A formal statement;
  • A valid foreign passport of a citizen of the Russian Federation;
  • A valid internal passport of a citizen of the Russian Federation (if available);
  • A document from the Russian tax authority confirming the absence of outstanding tax arrears;
  • A document from the Russian enforcement agency confirming the absence of pending enforcement proceedings.
