Confirmation of Russian citizenship at the consulate
While abroad, citizens of the Russian Federation go to the Russian consulate to obtain a new international passport. Sometimes, the consulate of the Russian Federation refuses to issue a document, claiming that the authorities at the Ministry of Internal Affairs have not confirmed that the person holds Russian citizenship.
Normally, these situations arise when a person left the country in the 1990s: during the period of the USSR’s disintegration, there was no time to maintain meticulous documentation. Moreover, these individuals, throughout their long period of residence abroad, manage to obtain one or two Russian passports for international travel, and on their third attempt to visit the consulate for the same matter, they are surprised to be denied: “Your citizenship is not confirmed.”
Is there a way out of this situation? There is a way out, but unfortunately it isn’t easy: you’ll have to go to court with a lawsuit to have the person recognised as a citizen of the Russian Federation. The most important thing in this type of court proceeding is to prove that the applicant was residing in the territory of the Russian Federation on February 6, 1992.

What is needed to go to court on your behalf?
We will need:
- a power of attorney (notarised or consular). It is likely that the consulate cannot be obtained due to the lack of a foreign passport;
- a written denial from the Consulate of the Russian Federation. It is not always possible to obtain a clear response from the consulate, whether a denial, so screenshots of correspondence showing that the person was denied the issuance of a new foreign passport because the consulate could not establish that the person held Russian citizenship will also suffice;
- documents confirming presence on the territory of the Russian Federation as of February 6, 1992;

The primary proof of residence is registration at the place of residence (empadronamiento) on the indicated date. As documents indirectly confirming residence in the Russian Federation, the following may be submitted to the court: the work record book, the military service certificate, certificates (diplomas) from educational institutions, certificates from medical institutions regarding care at the place of residence (medical records), the student’s personal file, etc.
