Changing a Company's Address
Every now and then, the need arises for a company to change its location address. This refers to the address where its office is located, where its employees work, and where it maintains relations with various state authorities, including the tax office.
The process of changing a location address only appears simple at first: there is a multitude of factors and regulations that will need to be taken into account. You’ll need to find a facility, get a lease signed, discuss with the facility owner your intent to use the address as the location for your company, and obtain confirmation from the owner that he not only doesn't mind providing the facility to you to lease but also for you to indicate its address in your company documents.
REMEMBER! Definitely be sure to check the address of the facility you're renting in the Federal Address System (FIAS), the specialized database created by the FTS of Russia specifically for the purposes of checking addresses.
If the address of the facility you chose to move to is not listed in the FIAS database, this may serve as grounds for your registration to be rejected, regardless of whether the company has concluded a lease agreement with the owner. The registration authority must check whether information about the address exists in the FIAS.
Thus, here are the steps you will need to take:
- Choose and check on an address.
- Sign a rental agreement.
- Decide whether or not to make this address change.
- Notify the registration authority on the decision you've made and submit documents on your change of address within 7 business days following the date of your decision. In the case that you miss the deadline, the company may be fined in the amount of 5,000 roubles.
If the company has decided not only to change the address but also to move to another region or city, the procedure will grow more complex and documents will need to be submitted to the registration authority twice, with a twenty-day interval in between.
As you can see, moving a company is always tedious and a major fuss. For that reason, it's better to entrust this task to professional lawyers who will not only help you prepare the necessary documents but also choose an address for you, check it in the FIAS database, and do everything you need to ensure that the company's move doesn't turn into a series of endless refusals and nagging from the tax office.
