As a general rule, court rulings are subject to execution as soon as they go into legal effect. Only after that can a writ of execution be issued, which is subsequently sent to the bailiffs service.

However, there is category of disputes whose rulings must be executed immediately, that is before the rulings enter into legal force. The writ of execution for such rulings can be obtained immediately after such a ruling is declared, even before the final form of the ruling is prepared.

In accordance with article 211 of the Civil Procedural Code, rulings on the following are subject to immediate execution:

  • child support garnishments;
  • payment of a salary to an employee within 3 months;
  • reinstatement at work.

In the case that a ruling is made in your favor within one of the aforementioned categories of disputes, after the court ruling is over, a writ of execution must be requested and it must be presented for execution.
